Summary
Die vorliegende Publikation liefert einen allgemeinen Überblick über das Geschlechtergleichstellungsrecht der EU. Auf eine kurze Beschreibung der historischen Entwicklung des Geschlechtergleichstellungsrechts der EU folgt ein Überblick über die maßgeblichen Rechtsvorschriften und Artikel des EG-Vertrags. Diese Vorschriften enthalten Regelungen zu Entgeltgleichheit und Gleichbehandlung von Männern und Frauen im Erwerbsleben, gesetzlichen und betrieblichen Systemen der sozialen Sicherheit, selbstständiger Erwerbstätigkeit sowie Zugang zu und Versorgung mit Gütern und Dienstleistungen. Eine Reihe zentraler Begriffe des Geschlechtergleichstellungsrechts, etwa der Begriff der unmittelbaren und mittelbaren Diskriminierung, und ihre Auslegung seitens des Europäischen Gerichtshofs werden genauer untersucht. Der Europäische Gerichtshof hat auf dem Gebiet der Gleichbehandlung von Männern und Frauen eine sehr wichtige Rolle gespielt, indem er dafür gesorgt hat, dass die Einzelnen ihr Recht auf Geschlechtergleichstellung wirksam geltend machen und durchsetzen können. Die vorliegende Publikation bietet einen Überblick über die wichtigsten Rechtssachen in diesem Bereich. Sie schließt mit der Erörterung einiger wesentlicher Aspekte der Durchsetzung des Geschlechtergleichstellungsrechts der EU und ein paar kurzen, allgemeinen Bemerkungen ab.

Summary
The present publication provides a general overview of gender equality law at the EU level. A brief description of the historical development of EU gender equality law is followed by an overview of the relevant EC Treaty Articles and legislation. This legislation covers equal pay and equal treatment for men and women in employment, statutory social security, occupational social security schemes, self-employment and access to and the supply of goods and services. A number of central concepts of EU gender equality law, such as direct and indirect discrimination and their interpretation by the European Court of Justice, are discussed. The European Court of Justice has played a very important role in the field of equal treatment between men and women by ensuring that individuals can effectively invoke and enforce their right to gender equality. This publication offers an overview of the most important case law in this area. It concludes with a consideration of certain vital aspects relating to the enforcement of EU gender equality law and some brief general observations.

La présente publication donne un aperçu général du droit européen en matière d'égalité des genres. Elle décrit succinctement l'évolution historique du droit de l'UE dans le domaine de l'égalité entre les hommes et les femmes avant de proposer un aperçu des articles du traité CE et des actes législatifs les plus pertinents. La législation visée couvre l'égalité des rémunérations et l'égalité de traitement entre hommes et femmes en matière d'emploi, de régime légal de sécurité sociale, de régimes professionnels de sécurité sociale, d'exercice d'une activité indépendante et d'accès aux biens et services. Toute une série de concepts fondamentaux du droit de l'UE relatif à l'égalité des genres (discrimination directe et indirecte notamment) sont également abordés, de même que leur interprétation par la Cour de justice européenne. Cette dernière a joué un rôle très important dans le domaine de l'égalité de traitement entre les hommes et les femmes dans la mesure où elle garantit aux particuliers la possibilité d'invoquer et de faire respecter effectivement leurs droits en la matière. La présente publication propose un aperçu des principaux cas de jurisprudence dans ce domaine. Elle se penche enfin sur plusieurs aspects essentiels de la mise en application du droit de l'UE relatif à l'égalité des genres avant de conclure sur quelques considérations générales.
